Do You Need a Permit to Build a Deck in Frederick County? Your Deck Permit Guide

Considering a new deck this year? If so, you’ve probably asked the big question already: Do you need a permit to build a deck? For homeowners in Frederick County, the answer is almost always yes. Attached decks, elevated decks, and pretty much anything you’d host a cookout on will need county approval before the first footing goes in. This guide walks through when a deck permit is required, what the code covers, and how the process works. And here’s the good news up front: when you work with an experienced local contractor, permitting is handled for you. Albaugh & Sons has been building decks across the greater Frederick area since 2003, and we know this process inside and out.

Do You Need a Permit to Build a Deck? The Short Answer

Yes. In most cases, you need a permit before construction begins. That’s true for nearly every attached deck, and for freestanding decks above a certain height or size.

Permits exist to make sure your deck is structurally sound, safe to stand on, and built to the codes Frederick County has adopted. A permitted, inspected deck protects your family, guests, and home value. An unpermitted deck can create headaches during insurance claims, refinancing, and home sales.

When Is a Deck Exempt From a Permit?

Some small decks may not require a permit. In many jurisdictions, a deck can be exempt if it’s freestanding, low to the ground, modest in size, and not attached to the house.

Here’s the catch, however: Those thresholds vary by jurisdiction, and they change as codes are updated. Before you rely on an exemption, confirm the current requirements with the county directly. Guessing wrong can mean tearing out finished work or paying penalties after the fact, and that costs far more than a deck permit ever would.

Deck Code Requirements Homeowners Should Know

You don’t need to memorize the building code; that’s your contractor’s job. Still, it helps to know what inspectors look for. Deck code requirements generally cover:

  • Footing depth: Footings must extend below the frost line so your deck doesn’t heave when Maryland’s freeze-thaw cycles kick in.
  • Guardrail height: Elevated decks need guardrails at a minimum height for safety.
  • Baluster spacing: Gaps between balusters are limited so small children can’t slip through.
  • Stairs and handrails: Rise, run, and handrail placement all follow specific rules.
  • Ledger attachment: The connection between deck and house gets close scrutiny, since ledger failures cause most deck collapses.

Exact figures follow the code Frederick County has adopted, so treat these as categories rather than specs. (If you’d like to see what code-compliant craftsmanship looks like, browse our deck gallery.)

Setbacks, Property Lines & HOA Rules

A permit covers how your deck is built. Setbacks govern where it can go. Frederick County zoning rules require structures to sit a certain distance from property lines, and a deck that creeps into a setback can stall your project fast.

If you live in a community with an HOA, expect a second layer of review. Many HOAs require design approval before construction, a sign-off separate from your county permit. Handle both before breaking ground.

How to Get a Deck Permit in Frederick County

The Frederick County deck permit process follows a familiar rhythm:

  • Prepare your plans: Site plan, dimensions, materials, footing details, and connection specs
  • Submit the application: File with the county along with your drawings
  • Pay the fee: Permit costs vary by project scope, so check with the county for current fees
  • Pass your inspections: Typically at the footing stage and again at final completion

Frederick County government and the City of Frederick run separate permitting offices. If your home sits within city limits, you’ll apply through the City of Frederick’s permits department. Everyone else goes through the Frederick County Division of Permits and Inspections. When in doubt, a quick call to either office will confirm which one covers your address.

Why Work With a Licensed Deck Contractor

When you work with a licensed deck contractor, you don’t have to manage any of this permitting business yourself. A licensed contractor drafts the plans, pulls the deck permit, schedules the inspections, and builds to code the first time.

Albaugh & Sons is both licensed and insured (MHIC #87642), and we’ve been navigating local permitting since 2003. We build custom decks across Frederick, Carroll, and Washington Counties, so we know the local codes, the inspectors’ expectations, and the Mid-Atlantic’s mercurial weather your deck has to stand up to. Permitting isn’t an add-on for us: It’s part of every project.

So great to work with. Have had the pleasure of working with both sons who were knowledgeable and courteous. The entire process was easy from estimate to completion of my new deck. Both arrived on time, had my estimate for both deck and basement remodel in a couple of days. Danny, the project manager arrived on time and explained the plans, the work crew were amazing. Old deck demolished and beautiful new composite in its place in less than 2 days. Tiffany, the office manager is prompt in responding to all emails with courteous knowledgeable answers. They make you feel like you are their only customer. Look forward to working with them for my basement remodel. I 100% recommend this company.

We needed a fence as fast as possible for 5 rescue dogs that we took on. Albaugh and Sons was able to provide a great quote and a speedy installation. My wife and I love the new fence. It has literally improved our day to day lives by being able to let the dogs run free in the back. The materials were perfect and high quality. I hired Albaugh and Sons to tear out our old deck and replace it with a new composite deck/ screened porch. The front office was a pleasure to deal with and kept my wife and I informed on everything. The crew did an amazing job every step of the way. I was especially impressed with their finish work. The attention to detail was impressive! What I also liked Albaugh and Sons is they had a project manager (Danny) who would occasionally pop over and answer questions and would also keep me updated on progress. I would highly recommend hiring Albaugh and Sons for any of your fence/ deck / home improvement needs.
